Recommendations for the Lao National Land Policy

Since 2012, LIWG has been supporting the development of the Lao National Land Policy. A set of four key recommendations has been developed, through extensive analysis and research over a year. The four Key Recommendations are related to the areas of:

– Expropriation

– Implementation

– Customary Tenure

– Communal Land Titling

Here is a summary of what is recommended:

Land ownership or use rights can only be revoked with the consent of the land holders; except for purposes that directly and primarily benefit the general public, and provided that the affected parties receive full and fair compensation. This applies to individually and communally held land, be it land held under customary ownership or with formal title.

To enhance implementation of the above recommendation, an independent agency should be assigned or established that has i) the responsibility to receive and resolve grievances related to land disputes and ii) the authority to enforce implementation of resolutions and relevant law. A publicly accessible database should be established showing documents and maps underlying approved land concession and lease contracts.
